Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Aether application (“Aether” or the “Software”) and the website at which it is offered (the “Site”). They form a binding agreement between you and the individual trading as SatySat, based in Mexico (“SatySat”, “we”, “us”, or “our”).

Please read these Terms carefully. By downloading, installing, purchasing, or using Aether, or by using the Site, you confirm that you have read and agree to these Terms and to our Privacy Policy and Refund Policy, which are incorporated here by reference. If you do not agree, do not use Aether or the Site.

1. Who we are

Aether is developed and published by an individual operating under the trading name “SatySat”, located in Mexico. SatySat is not a registered company; it is a sole individual doing business under that name. You can reach us at hello@satysat.com with any question about these Terms.

SatySat is an independent developer. We are not affiliated with, endorsed by, or sponsored by Adobe Inc. or by the makers of any third-party plugin, extension, or tool that Aether may detect or move. All product names, logos, and trademarks belong to their respective owners.

2. What Aether does

Aether is a desktop utility for macOS and Windows that helps you migrate your creative setup between computers. It scans supported Adobe applications on your machine, packages their settings, preferences, presets, plugins, extensions, scripts, and related files into a single archive (a “backup”), and restores those items onto another machine or a fresh installation.

Aether operates on files that already exist on your computer. It does not create, license, or supply any Adobe software or any third-party plugin, and using Aether does not grant you any rights to software or content that it copies or moves.

The list of supported applications, the items Aether can back up, and the behaviour of cross-platform (macOS ↔ Windows) restores are described on the Site and in the in-app documentation, and may change as Aether develops.

3. Licence to use Aether

Subject to your compliance with these Terms and your payment of the applicable fee, SatySat grants you a personal, worldwide, non-exclusive, non-transferable, non-sublicensable licence to install and use Aether for your own creative work.

Standard licence

A standard licence is a one-time purchase for use by one person, on the computers you personally own or control. It includes all future updates to Aether at no additional cost, for as long as Aether is offered.

Multiseat licences

A multiseat licence permits installation and use on the number of separate computers stated at the time of purchase, within a single organisation, school, or household. You are responsible for ensuring that every restored installation is properly licensed for the underlying Adobe software and any third-party components.

Monthly licence

A monthly licence grants the same rights as a standard licence for a period of one month from the date of purchase. It does not renew automatically, and it grants no rights after that month ends.

Licence keys

If we issue you a licence key, you are responsible for keeping it confidential. We may, now or in a future version, have Aether confirm a licence key with our payment provider before unlocking paid functionality; see the Privacy Policy for what that check involves.

4. Things you may not do

You agree that you will not, and will not permit anyone else to:

  1. resell, rent, lease, sublicense, distribute, or otherwise make Aether or a licence key available to any third party;
  2. share a single-seat licence across more computers or people than it permits;
  3. copy, modify, translate, or create derivative works of Aether, except as expressly allowed by law;
  4. reverse engineer, decompile, or disassemble Aether, or attempt to derive its source code, except to the limited extent that applicable law expressly permits despite this restriction;
  5. circumvent, disable, or interfere with any licensing, security, or usage-control mechanism in Aether;
  6. use Aether to copy, move, or distribute software, plugins, fonts, or other content that you are not licensed to use or transfer; or
  7. use Aether for any unlawful purpose or in violation of any third party’s rights.

5. Purchases, pricing, and the Merchant of Record

All purchases of Aether are made through Lemon Squeezy, our authorised reseller and Merchant of Record. This means that Lemon Squeezy, not SatySat, is the seller of record for your transaction: it handles payment processing, billing, fraud screening, and the collection and remittance of any applicable taxes. Your purchase is therefore also subject to the terms and policies that Lemon Squeezy presents at checkout, in addition to these Terms.

Prices are shown on the Site and at checkout in the currency indicated there, and may change at any time. A change in price does not affect a licence you have already purchased. From time to time we may offer discounts or promotional pricing; these apply only to the transactions they expressly cover.

You are responsible for providing accurate purchase information and for any taxes that are your responsibility under applicable law and not collected by Lemon Squeezy.

6. Refunds

If Aether does not work for you, we will fix it or refund you. The time window and the details are set out in our Refund Policy, which forms part of these Terms. We do not offer open-ended satisfaction refunds, because Aether delivers its value in a single migration rather than as an ongoing service. Because Lemon Squeezy is the Merchant of Record, approved refunds are issued by Lemon Squeezy to your original payment method.

7. Your responsibilities

  1. Licences for underlying software. You are solely responsible for holding valid licences, subscriptions, and serial numbers for every Adobe application and every third-party plugin, extension, script, or asset that you back up, move, or restore using Aether.
  2. Your data. Aether moves and copies files that matter to you. You are responsible for keeping your own independent backups. We strongly recommend that you keep the original backup archive produced by Aether until you have confirmed that a restore has completed correctly and that your applications work as expected.
  3. Administrator access. Some restore operations require administrator or elevated permissions on your computer. You are responsible for having the necessary access on the machines you use.
  4. Compliance. You are responsible for using Aether in line with your employer’s, school’s, or client’s policies where relevant, and with all applicable laws.

8. Intellectual property

Aether, the Site, and all software, text, graphics, logos, and other materials that we provide (excluding your files and anything owned by third parties) are the property of SatySat and are protected by intellectual property laws. Except for the licence expressly granted above, these Terms do not transfer any right, title, or interest in Aether or the Site to you.

The “Aether” and “SatySat” names and logos may not be used without our prior written permission.

9. Third-party software and links

Aether interacts with software made by others, including Adobe applications and third-party plugins and extensions. We do not control that software, we are not responsible for how it behaves before or after a restore, and its own licences and terms govern your use of it.

The Site may link to third-party websites or resources, including Lemon Squeezy. We provide those links for convenience only and are not responsible for the content, products, or practices of any third-party site.

10. Disclaimer of warranties

AETHER AND THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SATYSAT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT AETHER WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT EVERY SETTING, PRESET, PLUGIN, OR PREFERENCE WILL BE CAPTURED OR RESTORED PERFECTLY ON EVERY COMBINATION OF HARDWARE, OPERATING SYSTEM, APPLICATION VERSION, OR LANGUAGE. YOU USE AETHER AT YOUR OWN RISK.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. In that case, any legally required warranty is limited in duration and scope to the minimum permitted by law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SATYSAT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF WORK PRODUCT, LOSS OF PROFITS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO AETHER, THE SITE, OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO AETHER, THE SITE, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR YOUR AETHER LICENCE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless SatySat from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of Aether; (b) your violation of these Terms; (c) your infringement or misuse of any third party’s rights, including in software or content you back up or restore; or (d) your failure to hold the licences required for that software or content.

13. Term and termination

These Terms apply for as long as you use Aether or the Site. Your licence terminates automatically if you materially breach these Terms. On termination you must stop using Aether and delete your copies; a monthly licence also ends at the close of its one-month period.

Some sections survive termination by their nature, including “Intellectual property”, “Disclaimer of warranties”, “Limitation of liability”, “Indemnification”, “Governing law and disputes”, and “General”.

14. Governing law and disputes

These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles. Subject to the paragraph below, the courts located in Mexico will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or Aether.

Before filing anything, you agree to contact us first and attempt to resolve the dispute informally and in good faith. Most concerns can be sorted out quickly by email. Nothing in this section prevents either party from seeking urgent injunctive relief where necessary, and it does not override any mandatory consumer-protection rights available to you where you live.

15. Changes to these Terms

We may modify these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and, for material changes, take reasonable steps to note them on the Site. Changes are effective when posted. Your continued use of Aether or the Site after that means you accept the revised Terms; if you do not agree, stop using Aether and the Site.

16. General

These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and SatySat regarding Aether and the Site, and supersede any prior understanding on that subject. If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor to the Aether product. Section headings are for convenience only.
